If I can just pull apart your last post....

The fact is....you owe and it is as simple as that.

I Say:

If you had bothered to read the relevant Statutes in reference to this, i.e. Consumer Credit Act, you will find that it is you (Allied) who MUST be able to prove that a debt exists by providing anyone who lawfully requestsa true, certified copy of the credit agreement, which must contain the prescribed terms of such agreement. Without this it is impossible for you to collect any outstanding balances, even with intervention from the courts, if you cannot produce to the court a true, certified copy of the agreement , or the agreement does not contain the prescribed terms, the courts are prevented from issuing any order against the debtor.....Now that is a FACT.

You fail to see that even though you are frustrated, our aim is to clear you debt so that it does not follow you around much longer and create further problems.

Yes you feel badly treated but I can assure you that we are not breaking any rules and are following all relevant guidelines and are regulated all the time. If we were breaking so many rules then the public would know about it........would they not???

I Say:

Rubbish...All DCA's are interested in is personal gain. These debts are sold to companies such as yours for as little as 12p in the pound. Therefore the profits involved in the debt collection market are unbelievable.

You often use threatening and harrasing methods to grind people down and force them to pay more than they can afford, or advise them to take on more credit in order to pay what you say is owed.This is a direct breach of the OFT's guideleines on debt collection.

You add on charges to debts such as recovery charges, this is a direct breach of the OFT's guideleines on debt collection.

I have found every singleperson I have spoken to at Allied to be ignorant, condescending, and a know it all, when in fact you do not know the basic rules/regulations surrounding debt collection.

There is the address of a website doing just this in the posts below. These people have been there, done it, and beaten Allied and other DCA's.

Now,here's your homework, I suggest you read through S.61 and S.77-79 of the CCA1974, the OFT's guideleines on debt collection, and the Consumer Credit (Agreements) Regulations 1983 (SI 1983/1553). These regulations set out the form and content of agreements. For an agreement to be compliant with the regulations it MUST embody within the agreement, the prescribed terms laid out in the SI1983/1553 without the prescribed terms the agreement does not conform to section 60(1) 1974 and therefore cannot be properly executed as described in section 61(1) CCA 1974.

For your information in case you are unsure. The prescribed terms referred to are contained in schedule 6 column 2 of the Consumer Credit (Agreements) Regulations 1983 (SI 1983/1553) and are inter alia: - A term stating the credit limit or the manner in which it will be determined or that there is no credit limit, A term stating the rate of any interest on the credit to be provided under the agreement and A term stating how the debtor is to discharge his obligations under the agreement to make the repayments, which may be expressed by reference to a combination of any of the following--

(a)Number of repayments;

(b)Amount of repayments;

(c)Frequency and timing of repayments;

(d)Dates of repayments;

(e)The manner in which any of the above may be determined; or in any other way, and any power of the creditor to vary what is payable.
